Court Overturns CA Concealed-Carry Rule

In a blow to California gun law, a Federal appeals court on Thursday struck down a requirement by San Diego County that residents show “good cause” to carry a concealed firearm. The ruling could force local governments across California to revisit the way they license handguns.

Acting on a 2009 law suit, a three member panel of the 9th US Circuit Court of Appeals ruled 2-1 that San Diego County’s restrictions infringed on citizens’ Constitutional 2nd Amendment rights to bear arms.

Liberal run California is doing everything it can to force restrictive gun laws on its citizens. One state law largely bans the open carrying of firearms in public.  Combine that law with the San Diego County “good cause” rules, and residents are effectively barred from carrying a gun altogether, the panel said.

“In California, the only way that the typical, responsible, law-abiding citizen can carry a weapon in public for the lawful purpose of self-defense is with a concealed carry permit. And, in San Diego County, that option has been taken off the table,” Justice Thomas O’Scannlain wrote in the 77-page opinion for the majority.

California, with some of the nation’s strictest gun laws, allows residents to carry a concealed weapon if they meet several requirements.  Among these are:  completing a training course, demonstrating good moral character, and establishing “good cause” to have the gun.

Interpretation of the statute is left up to individual jurisdictions, and San Diego County took one of the most restrictive by refusing to accept self-defense or concern for personal safety as a “good cause.” Applicants are required to demonstrate a special need or a specific risk in order to establish good cause.

Lawyers for both sides agreed that the “Landmark Ruling,” if upheld, would force cities and counties across the state to issue permits to anyone who met the other requirements and who sought to carry a concealed weapon for self-defense.

“The 9th Circuit confirmed that the government no longer gets to pick and choose which law-abiding citizens may exercise their constitutional right to carry a firearm for self-defense,” said attorney Chuck Michel, who represented the plaintiffs challenging San Diego’s restrictions in the case. “This is a landmark ruling for the state of California. No longer will criminals have the security of knowing that their victims are defenseless in public.”


New Study: Gun Control Rhetoric Wrong

A new study coming out of Harvard will have gun control activists cringing.  It seems for all their rhetoric about the dismantling of the 2nd Amendment equaling fewer firearm deaths, the study proves quite the opposite.  In part the study reads:

shows numbers for Eastern European gun ownership and corresponding murder rates, it is readily apparent that less guns to do not mean less death. In Russia, where the rate of gun ownership is 4,000 per 100,000 inhabitants, the murder rate was 20.52 per 100,000 in 2002. That same year in Finland, where the rater of gun ownership is exceedingly higher–39,000 per 100,000–the murder rate was almost nill, at 1.98 per 100,000. Looking at Western Europe, the study shows that Norway “has far and away Western Europe’s highest household gun ownership rate (32%), but also its lowest murder rate.”

And then….”when the study focuses on intentional deaths by looking at the U.S. vs Continental Europe, the findings are no less revealing. The U.S., which is so often labeled as the most violent nation in the world by gun control proponents, comes in 7th–behind Russia, Estonia, Lativa, Lithuania, Belarus, and the Ukraine–in murders. America also only ranks 22nd in suicides.  The murder rate in Russia, where handguns are banned, is 30.6; the rate in the U.S. is 7.8.”

As someone who has been saying all along that gun control only controls honest, responsible gun owners, this study comes as no surprise.  It won’t be a surprise, either, when the gun-control crowd completely ignores the study and continues with their false rhetoric in order to advance their agenda.

California Confiscating Legally-Owned Guns

california-gun-confiscation-620x400I haven’t been able to verify this story, yet, but nothing would surprise me about the liberal government in my state.

Reports indicate that California has established a list of people who have legally-owned and registered firearms, but don’t deserve to have their 2nd Amendment rights preserved.  The list has been expanded by the State Legislator to include what they call “prohibited persons.”  It appears that this list is an ever-growing and changing over-reach by the state government, which includes such minor offenses as being behind on state taxes and not paying toll fees in a timely manner.

California is a money-strapped state…one could say the state is broke.  But, somehow, they managed to come up with $24 million to hire additional officers to track down 20,000 people whose names appear on the list.  Wouldn’t this money and man power be better used to break up the gangs in our state, and confiscate their guns?

Raids have already begun.  One gun-owner, Joe Mendez, reports that police shoved M16’s within inches of his face when they raided his home.  He was taken into custody and his legally-owned firearms confiscated.

I think this clearly shows how the government will use gun registration to take firearms away from lawful citizens.  We are coming closer and closer to living in a police state.  Sleep well, my friends…you never know when that knock might be on your door.


Women Who Feel They Are About to be Raped Shouldn’t Have a Gun

Some Republican men have made utterly stupid comments about women and rape – but Joe Salazar from Colorado definitely put his foot in his mouth in a big way. And, he made the typical lame apology that he was sorry IF he offended anyone. Read on for more about the most recent stupidity…

Colorado Democrat: Women Don’t Need Guns If They ‘Feel Like They’re Going To Be Raped’ *UPDATED

Chill, women, says Colorado Democrat Rep. Joe Salazar. While arguing for the disarmament ofcollege students, Salazar says that even if women feel like they’re going to be raped, they may not, so who needs a firearm for protection? From Revealing Politics:

Said Salazar:

“It’s why we have call boxes, it’s why we have safe zones, it’s why we have the whistles. Because you just don’t know who you’re gonna be shooting at. And you don’t know if you feel like you’re gonna be raped, or if you feel like someone’s been following you around or if you feel like you’re in trouble when you may actually not be, that you pop out that gun and you pop … pop around at somebody.”

This is the real “war on women” I’ve talked about: the progressive insistence that women disarm. Women, according to Rep. Salazar, are hysterical things which shoot indiscriminately at any and everything.

Some statistics, My emphasis:

In the vast majority of those self-defense cases, the citizen will only brandish the gun or fire a warning shot.
In less than 8% of those self-defense cases will the citizen will even wound his attacker.
Over 1.9 million of those self-defense cases involve handguns.
As many as 500,000 of those self-defense cases occur away from home.
Almost 10% of those self-defense cases are women defending themselves against sexual assault or abuse.

This “feel like you’re going to be raped” nonsense is as poorly-worded as the “shut that whole thing down” drama from last fall. If Democrats don’t swiftly condemn this, I see this used as a tactic to showcase the vast lack of respect Democrats have for a woman’s right to self defense.

*UPDATE #2: via Erickson and Jesse Byrnesthis is advice the University of Colorado gives to women to repel attackers. If an attacker isn’t grossed out enough over the prospect of raping/beating/murdering a woman, it’s doubtful that any of this will do the trick:

  1. Be realistic about your ability to protect yourself.
  2. Your instinct may be to scream, go ahead!  It may startle your attacker and give you an opportunity to run away.
  3. Kick off your shoes if you have time and can’t run in them.
  4. Don’t take time to look back; just get away.
  5. If your life is in danger, passive resistance may be your best defense.
  6. Tell your attacker that you have a disease or are menstruating.
  7. Vomiting or urinating may also convince the attacker to leave you alone.
  8. Yelling, hitting or biting may give you a chance to escape, do it!
  9. Understand that some actions on your part might lead to more harm.
  10. Remember, every emergency situation is different.  Only you can decide which action is most appropriate.

“I’m sorry if I offended anyone. That was absolutely not my intention,” Salazar said. “We were having a public policy debate on whether or not guns makes people safer on campus. I don’t believe they do. That was the point I was trying to make. If anyone thinks I’m not sensitive to the dangers women face, they’re wrong.

“I am a husband and father of two beautiful girls, and I’ve spent the last decade defending women’s rights as a civil rights attorney. Again, I’m deeply sorry if I offended anyone with my comments.”

If Salazar was truly sensitive to the dangers we face then he would understand how statistics do not work in our favor — unless we level the playing field by exercising our Second Amendment right. Salazar also doesn’t explain his insinuation that women basically ditzes who are incapable of proper reasoning and capable of handling firearms, in fact, he backhandedly defends it by saying it was a justifiable example for his prejudice against women’s defense.

Salazar claims to have a record of defending women’s rights but his actions to disenfranchise them of their Second Amendment rights are completely contradictory to that claim. One in four collegiate women report rape and one in five are raped. Salazar wants to deprive women of their right to defense with these odds? Just blow your rape whistles and pray that an attacker represents the “safe zone” boundaries? The best apology is a reversal of his war on women.

Congress Says Firearms Trafficking is a Federal Crime

I have to ask — why in the world was this not done long ago? To decide in 2013 that its a federal crime to traffic firearms seems like too little way too late. But let’s see them declare Fast and Furious to be a federal crime AND prosecute someone in power for that crime. Sadly that will likely happen about the same time some action is finally taken against anyone for the debacle in Benghazi….

CONGRESS – U.S. House lawmakers on Tuesday unveiled their first bipartisan bill targeting gun violence in this Congress: a measure to make firearms trafficking a federal crime.

During a press event, the bill’s sponsors — Reps. Patrick Meehan (R-Pa.), Carolyn Maloney (D-N.Y.), Scott Rigell (R-Va.) and Elijah Cummings (D-Md.) — said their legislation would create a single section of federal code to give law enforcement the ability to prosecute gun traffickers. It would also impose up to 20 years in jail for “straw purchasers,” or those who buy guns for people prohibited from buying them on their own. Their measure is among the recommendations included in the gun violence package put forward last month by President Obama.

But despite new efforts to reduce gun violence, statistical data reveal that stricter laws don’t always produce lower crime rates.

According to economist and gun rights advocate John Lott, Jr., gun control measures generally disarm law-abiding citizens and leave illegal gun access untouched. In fact, Lott cited statistics that found that more guns actually produced fewer murders.

Since the Federal Assault Weapons Ban expired in September 2004, murder and overall violent-crime rates have fallen. In 2003, the last full year before the law expired, the U.S. murder rate was 5.7 per 100,000 people, according to the Federal Bureau of Investigation’s Uniform Crime Report. By 2011, the murder rate fell to 4.7 per 100,000 people. One should also bear in mind that just 2.6% of all murders are committed using any type of rifle.

According to Lott, the 1994 legislation banned magazines holding more than 10 bullets yet had no effect on crime rates.

In 2011, almost 13,000 people were murdered with a weapon. Of those, 1,700 people were killed with knives; almost 500 were killed with hammers, bats, and clubs; and 728 were killed by another’s bare hands. Statistics show only 323 people were killed with rifles. That’s just 2.5 percent of all weapon-related murders.

The worst mass-murder in a school in American history did not involve guns or shooters; it involved a bomb in an elementary school. In 1927, a man set off 500 pounds of explosives in one wing of an elementary school in Bath, Michigan, killing 38 children. It would have killed more, but 500 pounds of dynamite that he had placed in another wing of the school failed to detonate.

There has been a lot of info about the surge in sales of guns and ammunition. I got an email earlier with a status of the gun industry – so I started doing some reason and want to share some of that with you.

Attention F.B. fans: to follow will be several IMPORTANT Info updates about the status of the gun industry currently, followed by an INVENTORY UPDATE: We traveled to Texas for Industry meetings concerning the shortages, here’s what we were told.

Smith & Wesson-is running at Full capacity making 300+ guns/day-mainly M&P pistols. They are unable to produce any more guns to help with the shortages.

RUGER: Plans to increase from 75% to 100% in the next 90 days.

FNH: Moving from 50% production to 75% by Feb 1st and 100% by March 1. Remington-Maxed out!

Armalite: Maxed out.

DPMS: Can’t get enough parts to produce any more product.

COLT: Production runs increasing weekly…bottle necked by Bolt carrier’s.

LWRC:Making only black guns, running at full capacity…can’t get enough gun quality steel to make barrels.

Springfield Armory: Only company who can meet demand but are running 30-45 days behind.

AMMO: Every caliber is now Allocated! We are looking at a nation wide shortage of all calibers over the next 9 months. All plants are producing as much ammo as possible w/ of 1 BILLION rounds produced weekly. Most is military followed by L.E. and civilians are third in line.

MAGPUL is behind 1 MILLION mags, do not expect any large quantities of magpul anytime soon.

RELOADERS… ALL Remington, Winchester, CCI & Federal primers are going to ammo FIRST. There are no extra’s for reloading purposes… it could be 6-9 months before things get caught up. Sorry for the bleak news, but now we know what to expect in the coming months. Stay tuned, we’ll keep you posted…

Every weapon of military utility designed within the past 100+ years was gone. This isn’t a society stocking up on certain guns because they fear they may be banned. This is a society preparing for war.

Barack Obama, Dianne Feinstein and the rest of the Statists have done more to promote gun ownership than theNRA ever did. Well done, Democrats!

Its Gun Violence Stupid

Washington Watch with Roland Martin

Very strange day in my world – I just saw a clip with Roland Martin and…. I agree with a lot of what he said. Who would’ve imagined that would ever happen. But – don’t get concerned that I’m going soft or shifting to the left…

In Roland Martin’s Washington Watch, he interviews a judge, a journalist and a political analyst/radio show host and they make some very important points. Again – I do NOT agree with everything, but they did make some valid points and I think its important to see that left leaning people do see and are willing to acknowledge some of the real issues that Congress and the Obama Administration are ignoring/missing.
